These Terms of Service ("Terms") govern your use of kpopscore.io (the "Service"), operated by Apollo Analytics LLC ("we", "us", "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

The Service is not directed at children under 13 years of age. By using the Service you represent that you are at least 13 years old. If you are between 13 and the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. The Service

KpopScore provides statistical rankings, comparisons, and analytics about musical artists and groups. Rankings are produced by combining data from multiple public and licensed sources and applying our proprietary scoring methodology, summarized on the "How It Works" page. Scores are derived analytics and may differ from numbers reported by any individual platform. The Service is currently provided free of charge; in the future we may offer paid tiers with additional features, governed by these Terms and any additional terms presented at the time of purchase.

3. No affiliation

KpopScore is not affiliated with, endorsed by, or sponsored by any artist, group, entertainment company, music platform, or chart. Artist names, group names, logos, and other trademarks referenced on the Service are the property of their respective owners and are used for identification purposes under the doctrine of nominative fair use.

4. No warranty

The Service is provided "as is" and "as available." We make no warranties, express or implied, about the accuracy, completeness, reliability, timeliness, or fitness of any score, ranking, event, or other information displayed on the Service. You should not rely on the Service for professional, commercial, or financial decisions without independent verification.

5. Acceptable use

You agree not to: (a) scrape, crawl, or otherwise access the Service in an automated fashion except via any public API we offer; (b) interfere with or disrupt the Service or its infrastructure; (c) attempt to gain unauthorized access to any non-public area of the Service; (d) use the Service to violate any law; (e) reproduce, resell, or commercially redistribute scores or data obtained from the Service without our prior written consent; (f) misrepresent your identity in communications with us, including in DMCA or privacy-rights requests.

6. Intellectual property

The Service's design, original text, scoring methodology, software, and the way data is selected, normalized, and combined to produce scores are proprietary to Apollo Analytics LLC or its licensors and are protected by copyright and other applicable laws. You may not reproduce, reverse-engineer, or create derivative works of these materials without our written permission, except for personal, non-commercial reference use. Trademarks and copyrighted works of third parties (for example, artist names and images) belong to their respective owners.

7. Copyright complaints (DMCA)

If you believe content on the Service infringes your copyright, you may submit a DMCA notice to contact@kpopscore.io with: (i) your contact information; (ii) identification of the copyrighted work; (iii) the URL of the allegedly infringing material; (iv) a statement of good-faith belief that the use is not authorized; (v) a statement under penalty of perjury that the information is accurate and you are authorized to act; and (vi) your physical or electronic signature. We will respond to properly formed notices in accordance with 17 U.S.C. § 512.

8. Advertising

The Service may display advertisements provided by third-party advertising networks. Where ads are shown, they are selected automatically and do not represent our endorsement of advertised products or services. See our Privacy Policy for details on advertising cookies, when applicable.

9. Limitation of liability

To the maximum extent permitted by law, Apollo Analytics LLC and its officers, directors, employees, and contractors will not be liable for any indirect, incidental, consequential, special, or exemplary damages arising out of or relating to your use of the Service, even if advised of the possibility. Our aggregate liability for any claim arising out of these Terms will not exceed USD $100.

10. Indemnification

You agree to indemnify and hold harmless Apollo Analytics LLC from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your misuse of the Service or violation of these Terms.

11. Changes to the Service and these Terms

We may modify or discontinue the Service at any time. We may revise these Terms by posting an updated version and changing the "Last updated" date. Material changes take effect 14 days after posting. Continued use after that date constitutes acceptance.

12. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to conflict-of-laws rules. Any dispute arising out of or related to the Service or these Terms will be resolved exclusively in the state or federal courts located in Pennsylvania, and you consent to personal jurisdiction there.

13. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force.
